Overview
Welcome to Lumiere Vive. The terms “we,” “us,” and “our” refer to Lumiere Vive. We operate this store and website, including all related information, content, features, tools, products, and services, to provide a curated shopping experience (the “Services”). Our store is powered by Shopify.
These Terms of Service, together with the policies referenced here, describe your rights and responsibilities when using the Services. Please read them carefully, including the provisions concerning warranties and limitations of liability.
By visiting, interacting with, or using the Services, you agree to these Terms of Service and acknowledge our Privacy Policy. If you do not agree to these terms, you should not use the Services.
Nothing in these terms limits rights you have under applicable consumer protection laws or other rights that cannot be waived by contract.
1. Access and accounts
By using the Services, you represent that you are at least the age of majority in your state or province of residence. Any use by minor dependents must be with the permission and supervision of their parent or legal guardian.
You may be asked to provide information such as your email address, billing address, shipping address, and payment information. You represent that the information you provide is accurate, current, and complete, and that you have the right to provide it.
You are responsible for maintaining the security of your account credentials and for activity under your account. You may not transfer, sell, assign, or license your account to another person.
2. Our products
We make reasonable efforts to display product information and images accurately. Colors and appearance may vary depending on your device, display settings, lighting, and other factors.
Product descriptions and availability may change. We may discontinue products or limit quantities offered to a person, geographic region, or jurisdiction, subject to applicable law.
Our boutique includes products sourced from independent brands. Brand names, manufacturer information, materials, sizing, and product-specific instructions are provided in the applicable listings when available.
3. Orders, cancellations, and returns
When you place an order, you offer to purchase the selected items and authorize us and our payment processors to charge your selected payment method for the total displayed at checkout.
We may accept or decline an order, subject to applicable law. Your order is accepted when we confirm acceptance after payment has been received and processed.
Please review your items, quantities, sizes, and shipping information before submitting an order. Once an order enters processing or fulfillment, changes or cancellations may no longer be possible.
If we decline, change, or cancel an order, we may contact you using the information provided at checkout. If we cancel items for which payment has been collected, we will refund the amount paid for those canceled items and any associated charges required to be refunded by applicable law.
Purchases are subject to our Returns & Store Credit Policy. Return requests must be made within 30 days of the purchase date. All returns require prior approval.
Returned items must be brand new, unused, unworn, and unwashed, with original tags attached and original packaging included. Customers are responsible for return postage. Original shipping charges are not credited.
Accepted returns receive store credit after the returned items arrive, are inspected, and are approved. We do not issue refunds to the original payment method for ordinary discretionary returns, except where required by applicable law. This does not affect refunds for orders we cancel or other mandatory rights.
You represent that purchases are for personal or household use rather than commercial resale or export.
4. Prices and billing
Prices, discounts, and promotions may change without notice. The price charged is the price applicable when you place your order, as reflected in your order confirmation, subject to the error provisions below.
Unless expressly stated otherwise, displayed product prices do not include taxes, shipping, handling, customs duties, or import charges. Applicable charges collected by us are shown at checkout before payment.
Our prices may differ from those offered by manufacturers, other retailers, or third parties. Promotions may have separate terms. If promotion terms conflict with these terms, the promotion terms govern that promotion.
You agree to provide current, complete, and accurate purchase, payment, and account information and to keep it updated. You represent that you are authorized to use the payment method provided and agree to pay the charges associated with your order.
5. Shipping and delivery
Some items ship directly from Lumiere Vive, while others ship from our brand partners. Orders containing products from multiple locations may arrive in separate packages on different days.
Processing and delivery estimates depend on the items ordered, fulfillment location, destination, and shipping method. Delivery dates are estimates unless expressly stated otherwise.
To the extent permitted by applicable law, we are not liable for delays caused by carriers, customs, severe weather, natural disasters, labor disputes, supply shortages, utility or telecommunications outages, cyber incidents, governmental actions, or other circumstances beyond our reasonable control.
To the fullest extent permitted by applicable law, title and risk of loss pass to you when products are transferred to the carrier, unless applicable law provides otherwise. This provision does not limit any non-waivable delivery or consumer rights.

6. Intellectual property
The Services, including text, photographs, graphics, logos, product reviews, video, audio, and other materials, are owned by Lumiere Vive, its affiliates, licensors, suppliers, or other applicable rights holders and are protected by intellectual property laws.
Purchasing a product does not transfer intellectual property rights in the product, its design, or related content. Those rights remain with their respective owners.
You may use the Services for personal, noncommercial purposes. Except as permitted by applicable law or with the relevant rights holder’s written permission, you may not reproduce, distribute, modify, create derivative works from, publicly display, republish, or commercially exploit materials from the Services.
Lumiere Vive’s names, logos, designs, and slogans belong to Lumiere Vive or the applicable rights holder. Shopify’s trademarks belong to Shopify. Other brand names and trademarks belong to their respective owners. No license to use these marks is granted by these terms.
7. Optional tools
We may provide access to tools offered by third parties that we do not control or monitor. Unless otherwise stated, access is provided “as is” and “as available,” without endorsement or warranties from us, to the extent permitted by law.
Your use of optional tools is at your discretion and subject to the relevant provider’s terms. To the extent permitted by law, we are not responsible for losses arising from those tools.
New features or tools introduced through the Services are also subject to these terms.
8. Third-party links
The Services may contain third-party materials, embedded features, or links to other websites. We do not control those websites and are not responsible for evaluating their content or accuracy.
Review the third party’s terms and privacy practices before using its services or completing a transaction on its website. Questions about purchases made directly through a third-party website should be directed to that third party.
Products purchased through Lumiere Vive remain purchases from Lumiere Vive, including when a brand partner fulfills the order. Please contact us about those purchases.
9. Relationship with Shopify
Lumiere Vive is powered by Shopify, which enables us to provide the Services. When you use the Services, your device communicates with Shopify’s systems.
Purchases made through our store are transactions directly between you and Lumiere Vive. Shopify is not the seller of those products.
To the extent permitted by applicable law, you acknowledge that Shopify is not responsible for sales between you and Lumiere Vive, including injury, damage, or loss resulting from purchased products or services, and release Shopify and its affiliates from claims, damages, and liabilities arising from those transactions.
10. Privacy
Our Privacy Policy explains how we collect, use, and disclose personal information.
Shopify also collects and processes information about your access to and use of the Services, including transaction and browsing information, for purposes such as providing, securing, and improving its services, processing transactions, and preventing fraud.
Information may be transmitted to Shopify and other service providers in countries outside your own. Review our Privacy Policy and Shopify’s Consumer Privacy Policy for more information.
11. Feedback and reviews
If you submit reviews, ideas, suggestions, proposals, or other feedback (“Feedback”), you grant us a perpetual, worldwide, sublicensable, royalty-free license to use, reproduce, modify, publish, distribute, and display that Feedback, including to operate, improve, and promote the Services.
You represent that you own or have the necessary rights to submit the Feedback, have disclosed any compensation or incentives connected with it, and that it complies with these terms.
We are not obligated to keep Feedback confidential, pay compensation for it, or respond to it. We may monitor, edit, or remove Feedback that is unlawful, abusive, threatening, defamatory, obscene, infringes another person’s rights, or otherwise violates these terms.
Feedback must not contain malware, false identity information, or material that violates another person’s intellectual property, privacy, or other rights. You are responsible for the Feedback you submit and its accuracy.
To the extent permitted by law, we are not responsible for Feedback posted by users or third parties.
12. Errors, inaccuracies, and omissions
Information on the Services may occasionally contain errors or omissions concerning descriptions, prices, promotions, shipping charges, transit times, or availability.
Subject to applicable law, we may correct errors, update information, or cancel orders affected by inaccurate information, including after an order has been submitted. If we cancel an order after collecting payment, we will issue the applicable refund.
13. Prohibited uses
You may use the Services only for lawful purposes. You may not:
- Violate applicable laws or regulations.
- Infringe intellectual property, privacy, or other rights.
- Harass, threaten, abuse, defame, or harm another person.
- Submit false information or impersonate another person or entity.
- Send spam, unsolicited advertising, or deceptive communications.
- Upload viruses, malware, or other harmful code.
- Collect or track others’ personal information without authorization.
- Copy, extract, resell, or commercially exploit the Services without permission.
- Use scraping tools, robots, automated processes, or agents to access the Services except as expressly authorized by us and in accordance with section 14.
- Interfere with security, bypass access controls, or evade restrictions on the Services.
- Otherwise restrict others’ use of the Services or expose Lumiere Vive, Shopify, or others to harm or liability.
Subject to applicable law, we may suspend or terminate access if we determine that these terms have been violated.
14. Automated agents
An “Agent” means software or a service that acts autonomously or semi-autonomously on behalf of a person or entity.
Agents may access or interact with the Services only as authorized by us and in accordance with this section. We may limit agent access through technical measures or other restrictions. An Agent must stop accessing the Services when requested.
Agents must:
- Identify themselves in HTTP or HTTPS requests using “Agent/[agent name]” in the user agent string.
- Not conceal or misrepresent their automated nature, including by mimicking human interaction to evade detection.
- Not complete or circumvent CAPTCHAs or other measures intended to distinguish automated activity from human activity.
- Answer truthfully when asked whether an interaction is automated.
- Not bypass measures that block, restrict, or control automated access.
15. Termination
Subject to applicable law, we may terminate or suspend your access to all or part of the Services. You remain responsible for amounts owed through the termination date.
Provisions that by their nature should survive termination remain effective, including provisions concerning intellectual property, Feedback, privacy, warranties, limitations of liability, indemnification, severability, assignment, and governing law.
16. Disclaimer of warranties
General information provided through the Services is offered for informational purposes. To the extent permitted by law, we do not guarantee its accuracy, completeness, or usefulness.
EXCEPT AS EXPRESSLY STATED BY LUMIERE VIVE, AND TO THE EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES AND PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT EXPRESS OR IMPLIED WARRANTIES OR CONDITIONS, INCLUDING MERCHANTABILITY, MERCHANTABLE QUALITY, FITNESS FOR A PARTICULAR PURPOSE, DURABILITY, TITLE, AND NON-INFRINGEMENT.
WE DO NOT GUARANTEE THAT THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE. THESE DISCLAIMERS DO NOT EXCLUDE WARRANTIES OR RIGHTS THAT CANNOT BE EXCLUDED UNDER APPLICABLE LAW.
17. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, LUMIERE VIVE, ITS PARTNERS, DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, SERVICE PROVIDERS, AND LICENSORS, AND SHOPIFY AND ITS AFFILIATES, WILL NOT BE LIABLE FOR INJURY, LOSS, CLAIMS, OR DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM USE OF THE SERVICES OR PRODUCTS PURCHASED THROUGH THEM.
THIS INCLUDES, TO THE EXTENT PERMITTED BY LAW, LOST PROFITS, REVENUE, SAVINGS, DATA, REPLACEMENT COSTS, AND SIMILAR LOSSES, WHETHER BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE, EVEN IF ADVISED OF THEIR POSSIBILITY.
NOTHING IN THESE TERMS EXCLUDES OR LIMITS LIABILITY THAT CANNOT LAWFULLY BE EXCLUDED OR LIMITED.
18. Indemnification
To the extent permitted by applicable law, you agree to indemnify, defend, and hold harmless Lumiere Vive, Shopify, and the respective affiliates, partners, officers, directors, employees, agents, contractors, licensors, and service providers from third-party claims, liabilities, damages, and reasonable legal fees arising from your breach of these terms, violation of law or another person’s rights, or use of the Services.
We will notify you of an indemnifiable claim. A delay in notice will not relieve your obligations unless it materially prejudices you. We may control the defense and settlement, including selecting counsel, but will not settle a claim that imposes nonmonetary obligations on you without your consent, which must not be unreasonably withheld. You agree to reasonably cooperate in the defense.
19. Severability and mandatory rights
If a provision is determined to be unlawful, void, or unenforceable, it will apply to the fullest extent permitted by law, and any unenforceable portion will be severed without affecting the remaining provisions.
Mandatory consumer protection rights prevail over any conflicting provision in these terms.
20. Waiver and entire agreement
Our failure to enforce a provision does not waive our right to enforce it later.
These terms and the policies incorporated by reference form the entire agreement concerning use of the Services and replace prior agreements, communications, and proposals concerning that subject.
To the extent permitted by applicable law, ambiguities will not automatically be construed against the drafting party.
21. Assignment
You may not transfer, assign, or delegate your rights or obligations under these terms without our prior written consent. We may transfer, assign, or delegate our rights and obligations, subject to applicable law.
22. Governing law
These terms are governed by the laws of the jurisdiction where Lumiere Vive is headquartered or incorporated, without regard to conflict-of-law principles.
You and Lumiere Vive consent to the jurisdiction and venue of courts in that jurisdiction, except where prohibited by law. This does not limit your right to rely on mandatory laws applicable where you live or to bring claims in your local courts where that right is protected.
23. Translations
If these terms are available in multiple languages, the most current English version governs inconsistencies to the extent permitted by law. Disputes will be handled in English unless we agree otherwise or applicable law requires another language.
24. Headings
Headings are provided for convenience and do not limit or change the meaning of these terms.
25. Electronic communications
By using the Services or placing an order, you agree that we may send transactional and service-related communications electronically, including by email, account notice, or notices posted through the Services.
These messages may concern orders, purchases, returns, accounts, or changes to the Services and these terms. Please keep your contact information current. Marketing communications are subject to applicable consent requirements and your communication preferences.
26. Changes to these terms
The current version of these terms is available on this page. We may update or replace provisions by publishing a revised version.
We will provide notice of material changes as required by applicable law. Those changes take effect on the date stated in the notice. Continued use of the Services after changes take effect constitutes acceptance to the extent permitted by law.
